Gift Card Terms and Conditions

We are Atom Supplies Limited, trading as Drinks by the Dram, a company registered in England and Wales under company number 3193057 having its registered office at Unit 1, Ton Business Park, 2-8 Morley Road, Tonbridge, Kent, TN9 1RA, which is also our main trading address. We are registered for VAT and our VAT number is GB 662241553.  We operate the website www.drinksbythedram.com and issuer of the Drinks by the Dram gift cards. 

1. The following words will have these meanings in these terms:
   1. “gift card(s)” refer(s) only to the Drinks by the Dram gift card(s) as being sold and bought on www.drinksbythedram.com;
   2. “product(s)” means any product that is made available for sale and bought by you on www.drinksbythedram.com;
   3. “purchaser” means the individual who buys the gift card;
   4. “site” refers to the www.drinksbythedram.com website;
   5. “us”, “we”, “our” means Atom Supplies Limited, details above; and
   6. “you”, “your” means a website user, potential consumer, purchaser of the gift card, a recipient of the gift card, or a redeemer of a gift card.

1. Gift cards are only redeemable against any product available for sale on the site and not anywhere else. 
2. Each gift card will be associated with a unique serial number.  You can only redeem a gift card by placing an order online via the site and entering the serial number of the gift card at checkout.  Any order for a product which is paid for (in whole or in part) using the gift card shall be made on and subject to our Consumer Terms of Business.
3. A person other than the purchaser of the gift card may redeem the gift card in accordance with these terms. 
4. The value of the gift shall be as specified on the gift card.  In circumstances where the value of any product ordered exceeds the value of the gift card, you can pay the difference using any of the payment methods accepted on the site from time to time. 
5. In circumstances where the value of any product ordered is less than the value of the gift card, the remaining value of the gift card can be used on a separate order. 
6. Multiple gift cards may be redeemed in the same transaction. 

1. Any gift card, including any unused balances, expires when its value is completely used up. 
2. Gift cards have no cash value and cannot be set off against a product that has already been paid for using another payment method. 
3. Gift cards cannot be used to purchase gift cards.
4. We reserve the right to refuse to accept a gift card as payment in circumstances where we consider (acting reasonably and in our sole discretion) that the gift card has been stolen, or is being used to commit fraud, or as part of a fraudulent transaction, or is otherwise being used improperly.

1. Gift cards can be returned for a refund at any time but only the purchaser can obtain a refund.  Unless otherwise agreed by us, we can only issue refunds using the original method of payment, to the same payment account.  
2. The original purchaser will be required to provide their gift card serial number in order for us to go through the refund process.  
3. We will not be responsible for any gift cards that are lost, stolen, destroyed or used without your permission. 
4. We reserve the right to refuse refund to all or any part of a gift card or to send a replacement gift card in our sole determination and for whatever reason, including but not limited to in circumstances where we consider a request for refund or replacement is made fraudulently, made as part of a fraudulent transaction, or is otherwise being made improperly.  

1. We may revise these terms at any time by amending this page. Please check back from time to time to take notice of any changes we make, as they are legally binding on you. 
2. We may revise these terms as they apply to any gift card which has been issued but not redeemed in order to reflect applicable law and regulatory requirements (including, without limitation, regulations relating to taxation) and/or changes to applicable law and regulatory requirements (including, without limitation, regulations relating to taxation).
3. These terms shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
